Welcome to MyBookCubby. By downloading, installing, or using our mobile application ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

1. Acceptance of Terms

By accessing or using MyBookCubby, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms of Use and our Privacy Policy.

2. Description of Service

MyBookCubby is a personal media cataloging application that allows you to organize and track your collections of books, movies, music, and video games. The App provides barcode scanning, manual entry, search, and import features to help you manage your personal library.

3. User Accounts and Data

Your media library data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App. We are not responsible for any loss of data resulting from device failure, loss, or unauthorized access to your device.

4. Acceptable Use

You agree to use the App only for its intended purpose of personal media cataloging. You agree not to attempt to reverse engineer, decompile, or disassemble the App, use the App for any unlawful purpose, or attempt to interfere with the proper functioning of the App.

5. Third-Party Services

The App may connect to third-party APIs (such as Open Library and MusicBrainz) to retrieve metadata about media items. Your use of information obtained through these services is subject to the respective terms and policies of those third-party providers. We do not control and are not responsible for the content or accuracy of third-party data.

6. Intellectual Property

The App and its original content, features, and functionality are owned by MyBookCubby and are protected by applicable copyright, trademark, and other intellectual property laws. Book cover images, descriptions, and other metadata retrieved from third-party sources remain the property of their respective owners.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the accuracy or completeness of metadata retrieved from third-party services.

8. Limitation of Liability

To the fullest extent permitted by law, MyBookCubby shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or damage to your device.

9. Changes to These Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective when posted within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the updated terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
